Realty transfer tax in Burlington County: Realty Transfer Fee, graduated and paid by the seller
The Realty Transfer Fee falls on the seller and is graduated, from $2.00 per $500 on the first $150,000 to $6.05 per $500 on consideration over $1,000,000, with separate reduced rates for senior, blind, disabled and low and moderate income sellers. On sales over $1,000,000 the Graduated Percent Fee applies, having replaced the flat 1 percent mansion tax on July 10, 2025 under P.L. 2025 c.69. It is 1 percent to 3.5 percent of the entire consideration as a straight percentage, and the statute moved liability from the buyer to the seller. RTF-1 is filed with any deed claiming an exemption, and RTF-1EE must be annexed to every deed over $1,000,000 and every commercial transfer.
Recording a deed in Burlington County

The Clerk publishes the recordable deed requirements with citations: English and legible text, grantor and grantee names, the grantee's mailing address, the date, consideration with the Realty Transfer Fee, the GIT/REP seller residency declaration, municipal block and lot, signature, acknowledgment with printed names, the preparer's printed name and a cover sheet. Burlington states specifically that any GIT/REP form signed on or after October 1, 2025 must be the newest version, and older versions are rejected. A cover sheet has been required on all land documents since May 1, 2017.

Under N.J.A.C. 11:5-6.2(g) the period is three days, excluding Saturdays, Sundays and legal holidays, running from delivery of the signed contract to the buyer and the seller, so delivery to both parties starts it. The contract becomes binding at the end of the window unless an attorney for either side disapproves and notifies the brokers and the other party within it. Only a written agreement of buyer and seller extends it. The rule reaches contracts prepared by a licensee for one to four dwelling unit residential property and vacant one family lots, not attorney drafted contracts. Conley v. Guerrero, 228 N.J. 339 (2017), permits disapproval by fax, e mail, personal delivery or overnight mail with proof of delivery, with overnight mail effective on mailing, although the regulation still lists only certified mail, telegram or personal delivery.
The smoke, carbon monoxide and extinguisher certificate
N.J.A.C. 5:70-2.3 and N.J.S.A. 52:27D-198.1 require the owner to obtain a Certificate of Smoke Alarm, Carbon Monoxide Alarm and Portable Fire Extinguisher Compliance before a one or two family or attached single family structure is sold, leased or made subject to a change of occupancy. The fee schedule at N.J.A.C. 5:70-2.9(d) is $45 more than 10 business days out, $90 at four to 10 business days and $161 at fewer than four, and a municipality may adopt a different schedule by ordinance based on actual cost. The extinguisher fails inspections most often: it must sit within 10 feet of the kitchen in the path of egress, be rated at least 2A-10B:C, weigh no more than 10 pounds, hang on the manufacturer's bracket with instructions visible, have its top no more than five feet above the floor and carry a service tag from a certified Division of Fire Safety contractor dated within the last 12 months. The certificate is not transferable and a new application is required if the specified change of occupancy has not happened within six months. Because Burlington is large and the certificate is issued by the local fire enforcing agency, scheduling genuinely varies town to town.
The summary page counts as page one
Burlington counts the summary page as the first page of the document, so the published first page charge for a deed is $45 rather than the $30 base other counties advertise. Each additional recorded page is $10 on top of that. Cover sheets themselves are free and uncounted when the document is e-recorded, but a paper cover sheet is counted as an extra page. Quoting the state base rate to a seller in Burlington will understate the recording line, so quote the county schedule.
