Realty transfer tax in Essex County: Realty Transfer Fee, graduated and paid by the seller
The Realty Transfer Fee is imposed on the seller and is graduated rather than flat, on two schedules, $2.00 to $3.90 per $500 at or below $350,000 and $2.90 to $6.05 per $500 above it on consideration over $1,000,000, with lower schedules for senior, blind, disabled and low and moderate income sellers. Sales over $1,000,000 also trigger the Graduated Percent Fee that replaced the 1 percent mansion tax on July 10, 2025 under P.L. 2025 c.69, and that statute shifted liability from the buyer to the seller. The fee is 1 percent to 3.5 percent taken as a straight percentage of the entire consideration, so a $2.75 million transfer produces $68,750 due at recording under Treasury's own worked example. RTF-1 goes with any deed claiming an exemption and RTF-1EE must be annexed to every deed over $1,000,000 and every commercial transfer.
Recording a deed in Essex County
The Essex County Register of Deeds and Mortgages sits at Hall of Records, Room 130, 465 Martin Luther King, Jr. Blvd., Newark, New Jersey 07102, 973-621-4960. The current recording fee is $45 for the first page of a deed, tax abstract included. Additional recorded pages are $10 each and names after the fifth are $6 each. The $5 homelessness trust fund charge has been included in the published figures since July 1, 2015. The office has accepted electronic recording since December 2006 through the njcountyrecording.com consortium, and the e-recording convenience fee ended March 8, 2019 by order of the Hudson County Superior Court in NJ Land Title Association v. Rivera.
The deed must carry Realty Transfer Fee payment with RTF-1 or RTF-1EE where applicable, the GIT/REP seller residency declaration, the grantee's mailing address, municipal block and lot, acknowledgment with printed names and the preparer's printed name. A cover sheet has been required on all land documents since May 1, 2017. Counter hours are 8:30 am to 4:30 pm with the last transaction accepted at 4:15 pm, so a walk in after 4:15 records the following day.

The three business day attorney review clock
N.J.A.C. 11:5-6.2(g) sets three days, excluding Saturdays, Sundays and legal holidays, running from delivery of the signed contract to the buyer and the seller, which means delivery to both parties. Absent a timely disapproval the contract is legally binding at the end of the period, and a disapproving attorney must notify the brokers and the other party inside the window. Extension is possible only by written agreement of the buyer and the seller. The rule applies to contracts prepared by a licensee for one to four dwelling unit residential property and vacant one family lots, not to attorney drafted contracts. Conley v. Guerrero, 228 N.J. 339 (2017), held that disapproval may be transmitted by fax, e mail, personal delivery or overnight mail with proof of delivery, with overnight mail effective upon mailing, and the three business day period was left unchanged.
The smoke, carbon monoxide and extinguisher certificate
The owner must obtain a Certificate of Smoke Alarm, Carbon Monoxide Alarm and Portable Fire Extinguisher Compliance before a one or two family or attached single family structure is sold or made subject to a change of occupancy, under N.J.A.C. 5:70-2.3 and N.J.S.A. 52:27D-198.1, and the local fire enforcing agency issues it. The published fee schedule at N.J.A.C. 5:70-2.9(d) is $45 more than 10 business days ahead, $90 at four to 10 business days and $161 at fewer than four, and a municipality may adopt a different schedule by ordinance based on actual cost. Extinguisher rules produce most reinspections: within 10 feet of the kitchen, in the path of egress, at least 2A-10B:C, no more than 10 pounds, on the manufacturer's bracket with instructions visible, top no more than five feet above the floor, and serviced and tagged by a certified Division of Fire Safety contractor within the past 12 months. Smoke alarms must be on each level and outside each separate sleeping area, and an alarm that was AC powered from original construction or a rehab cannot be replaced with a battery unit. Where a municipality already runs its own property maintenance or carbon monoxide inspection regime, a separate CSACMAPFEC is not required, so the local rule has to be checked rather than assumed.
No e-recording convenience fee anywhere in New Jersey
Essex stopped charging its e-recording convenience fee on March 8, 2019 under an order of the Hudson County Superior Court in NJ Land Title Association v. Juan M. Rivera, Jr., and every other portal county suspended its own fee effective April 1, 2019 following the Appellate Division decision in NJLTA v. Rone. A statement that still carries that line is quoting a charge the county no longer collects. What does still apply in Essex is the $10 per additional page, $6 per name after the fifth and the tax abstract already folded into the $45 first page figure. The homelessness trust fund charge has been included in the published Essex figures since July 1, 2015.
