Realty transfer tax in Ocean County: Realty Transfer Fee, graduated and paid by the seller

New Jersey's Realty Transfer Fee is imposed on the seller and is graduated on two mutually exclusive schedules: at or below $350,000 it runs $2.00 to $3.90 per $500, and above $350,000 it runs $2.90 to $6.05 per $500, with reduced rates for senior, blind, disabled and low and moderate income sellers. Sales over $1,000,000 also trigger the Graduated Percent Fee, which replaced the flat 1 percent mansion tax on July 10, 2025 under P.L. 2025 c.69 and moved liability from the buyer to the seller. It is charged at 1 percent to 3.5 percent of the entire consideration as a straight percentage, not a bracketed amount, which makes it a large single line on waterfront and barrier island files. RTF-1 accompanies any deed claiming an exemption, and RTF-1EE must be annexed to every deed over $1,000,000 and every commercial transfer.

Recording a deed in Ocean County

The Ocean County Clerk sits at 118 Washington Street, Toms River, New Jersey 08753, 732-929-2018. The current recording fee is $45 for the first page of a deed, inclusive of the $5 homelessness trust fund and the first marginal notation. Additional recorded pages are $10, names beyond the fifth are $6 each, a re-recording is $10 and a municipal document is a flat $13. A document submitted without a cover sheet draws a $20 fee. The deed has to carry Realty Transfer Fee payment with RTF-1 or RTF-1EE where applicable, the GIT/REP seller residency declaration, the grantee's mailing address, municipal block and lot, acknowledgment with printed names and the preparer's printed name. A cover sheet has been required on all land documents since May 1, 2017, and Ocean charges $20 when one is missing. E-recorded cover sheets are free and not counted as a page, but a paper cover sheet is counted as an additional page.

Under N.J.A.C. 11:5-6.2(g) the window is three days, excluding Saturdays, Sundays and legal holidays, and it runs from delivery of the signed contract to the buyer and the seller, meaning delivery to both parties. The contract becomes legally binding at the close of the period unless an attorney for either side disapproves and notifies the brokers and the other party within it. Only a written agreement of buyer and seller extends the period. The rule applies to contracts prepared by a licensee for one to four dwelling unit residential property and vacant one family lots, not to attorney drafted contracts. Conley v. Guerrero, 228 N.J. 339 (2017), permits the disapproval notice by fax, e mail, personal delivery or overnight mail with proof of delivery, with overnight mail effective on mailing, although the regulation has never been amended to say so.

The smoke, carbon monoxide and extinguisher certificate

N.J.A.C. 5:70-2.3 and N.J.S.A. 52:27D-198.1 require the owner to obtain a Certificate of Smoke Alarm, Carbon Monoxide Alarm and Portable Fire Extinguisher Compliance before a one or two family or attached single family structure is sold or made subject to a change of occupancy, and the local fire enforcing agency issues it. The fee schedule at N.J.A.C. 5:70-2.9(d) is $45 for applications received more than 10 business days ahead, $90 at four to 10 business days and $161 at fewer than four, and a municipality may adopt its own schedule by ordinance based on actual cost. Extinguisher compliance is the usual sticking point: within 10 feet of the kitchen, in the path of egress, at least 2A-10B:C, no more than 10 pounds, on the manufacturer's bracket with instructions visible, top no more than five feet off the floor, and serviced and tagged by a certified Division of Fire Safety contractor within the past 12 months. Seasonal summer units occupied for 125 consecutive days or fewer are excused from the extinguisher requirement, which is a live distinction on the barrier island. Certificates are not transferable, and seasonal rentals may be issued for up to 12 months while sale certificates lapse if the specified change of occupancy does not occur within six months.

The Clerk's published terms limit payment to cash, check or an escrow account, so a card at the counter is not an option and a courier without a check will not get a deed on record. The office maintains a 24 hour document drop box, and documents left in it are processed the next business day rather than same day. Missing the cover sheet costs $20 on top of the base charge.
