Transfer tax in Passaic County

New Jersey's Realty Transfer Fee is imposed on the seller and runs on two mutually exclusive schedules, which must never be blended. At total consideration of $350,000 or less it is $2.00 per $500 up to $150,000, $3.35 per $500 from $150,000 to $200,000, and $3.90 per $500 from $200,000 to $350,000. Above $350,000 a different schedule applies to the whole amount: $2.90 per $500 up to $150,000, $4.25 per $500 to $200,000, $4.80 per $500 to $550,000, $5.30 per $500 to $850,000, $5.80 per $500 to $1,000,000, and $6.05 per $500 above that. Reduced schedules exist for senior, blind, disabled, and low and moderate income sellers, and a notarized Form RTF-1 must be annexed to the deed to claim one. Consideration over $1,000,000 also triggers the Graduated Percent Fee that replaced the old 1 percent mansion tax on July 10, 2025 under P.L. 2025 c. 69: 1 percent above $1,000,000, 2 percent above $2,000,000, 2.5 percent above $2,500,000, 3 percent above $3,000,000, and 3.5 percent above $3,500,000, charged as a straight percentage of the entire consideration rather than as brackets. Liability for it shifted from the buyer to the seller, and the Division of Taxation is explicit that the operative date is when the deed is submitted for recording, not the closing date. Form RTF-1EE must be annexed to every deed over $1,000,000 and to every commercial transfer. There is no separate Passaic County transfer tax. Recording a deed in Passaic County

The Passaic County Clerk, Registry Division sits at 401 Grand Street, Room 113, Paterson, New Jersey 07505, 973-881-4777. The current recording fee is $45 for the first page of a deed, plus $10 for each additional page. Easements and assignments of rents and leases are also $45 for the first page plus $10 per page. Mortgages and powers of attorney are $35 for the first page plus $10 per page. A discharge of mortgage is $45 first page plus $10 per page, with $10 more for a second book and page, and an assignment of mortgage is $40 first page plus $10 per page on the same terms. A mortgage cancellation is $25, a notice of settlement is $20 for two parties and $40 for three, and certified copies are $10 for the first page plus $2 per page. The Registry is open weekdays 8:30 to 4:15. The Clerk's office states that appointments are not required, but customers with appointments are prioritized over walk ins. When each one applies is explained in the requirements below.

The GIT/REP form is absolute: Form GIT/REP-3 states that if it is not completed in its entirety, or the settlement agent does not submit the original with the deed, the county will not record the deed. Form RTF-1 must accompany any deed claiming a full or partial Realty Transfer Fee exemption, and Form RTF-1EE must be annexed to every deed over $1,000,000 and every commercial transfer. The Registry requires the official county cover sheet on every document or charges an additional $20 per document without one. Its recording procedures add county level conditions: every instrument must be in English, legible, and properly acknowledged, every signature must be original with the name printed underneath, every deed must carry the words Prepared by followed by the name of the drafter, the tax block, lot, and consideration must be shown, and a record and return address is required. The Registry lists the Affidavit of Consideration (buyer and seller versions), the nonresident seller tax declaration, the seller residency certification or exemption, and the waiver of seller's filing requirement among its most common errors. It does not record surveys and does not perform title searches.

What actually holds up a closing here

Clifton's dwelling certificate has a 60 day window and a $300 rush tier

Clifton City Code Chapter 210 requires every owner and/or tenant to file a dwelling certificate not more than 60 days prior to any conveyance of title under section 210-2C, as amended 7-5-2000, and section 210-5 bars the transfer of title of any dwelling unit until a dwelling inspection has been conducted. Section 210-3A requires the change of ownership inspection to happen before the transfer, and it checks compliance with the City's smoke detector and housing standards chapters. The fee under section 210-4A, amended 2-22-2006 by Ordinance 6553-06, turns on notice: $125 per unit with 20 or more business days, $200 per unit at four to 20, and $300 per unit at four or fewer. The cheapest tier therefore sits between 60 calendar days and 20 business days before closing, so file in that window rather than at contract. Section 210-6 requires the Tax Search Official to give everyone who requests a tax search a statement calling attention to the chapter, and section 210-7A sets fines of $100 up to $1,250.

The City of Passaic names the owner's agent in the violation

City of Passaic Code section 219-10G, added 6-9-2004 by Ordinance 1620-04, makes it a violation for any owner or agent of any owner to sell real property without applying for a reinspection and obtaining an occupancy certificate, and section 100-3F of the certificate of occupancy chapter states the same rule. Where the owner has been noticed for violations, section 219-10A bars the sale without prior approval of the Director of Housing Inspections, and under section 219-10B that approval issues only after the purchaser signs an agreement with the Division of Housing setting a correction date and posts a bond in an amount the Director sets. Section 219-10E makes the buyer equally responsible after notice, and section 219-10F counts each day from closing until correction as a separate violation. The continued occupancy certificate fee under section 100-10A, most recently amended 2-17-2026 by Ordinance 2515-26, is $65 for the first unit, $35 per unit for the second through twentieth, and $25 per unit after that, plus $50 under section 100-10C when inspectors cannot enter on the scheduled date.

Wayne starts its 15 business day clock only after every permit is closed

Wayne Township Code section 100-2 bars any change in tenancy, use, or ownership of residential premises without a certificate of continued occupancy, exempting only transfers between spouses, parents and children, and siblings. Under section 100-5, as amended 10-21-2020 by Ordinance 41-2020, the Enforcement Officer has 15 business days after closure of all open permits to issue the certificate or list deficiencies, so an unclosed permit stops the clock before it starts. The inspection is a zoning and property maintenance review that looks for unpermitted additions, attic or basement apartments, second kitchens, decks, pools, garages, and sheds. The Township adds that expediting fees apply to inspections needed sooner than 10 days, that the certificate expires 90 days after issuance if closing has not occurred, and that a separate fire inspection is also required. If violations remain, section 100-2.1A allows closing on a homeowner's or purchaser's agreement for no more than 60 days, after which the applicant must reapply and pay again.

West Milford skips the CCO, but a well means a uranium test

West Milford's Building Department states that the Township does not require a Certificate of Continued Occupancy on resale, will confirm that in writing for a $40 fee, and requires only the smoke detector certification from the Fire Prevention Department at 973-728-2840. The Fire Marshal's instructions, revised February 10, 2025, price it by lead time: $55 more than 10 business days before closing, $100 at four to 10, $165 at fewer than four, and $50 per reinspection, with certifications performed on Wednesdays and certificates valid six months. The Township also says it will not require a seller to remove an active, non leaking underground oil tank, leaving that to the contract, and it refers well and septic questions to the Health Department. On any property served by a private well, Passaic is one of the counties where N.J.A.C. 7:9E-2.1(c) adds uranium to the Private Well Testing Act panel, on top of statewide parameters that include arsenic, gross alpha, lead, and since December 1, 2021 PFNA, PFOA, and PFOS. Results are good for one year from sample collection, except coliform results, which are valid six months.

The Registry still calls the mansion tax a buyer fee

The Registry Division accepts only an attorney trust account check, a title agency trust account check, a certified check, or cash for the Realty Transfer Fee, and its page still describes the companion charge as the 1 percent Buyer/Grantee Fee. Under P.L. 2025 c. 69 that charge became the Graduated Percent Fee imposed on the seller for every deed submitted for recording on or after July 10, 2025, so treat the tender rule as current and the label as stale. Ordinary checks have their own traps here: they must have the name and address printed on them, checks dated more than 90 days earlier are refused, and anything of $10,000 or more must be certified or a money order.
