Transfer tax in Union County

New Jersey's Realty Transfer Fee is imposed on the seller and runs on two mutually exclusive schedules, which must never be blended. At total consideration of $350,000 or less it is $2.00 per $500 up to $150,000, $3.35 per $500 from $150,000 to $200,000, and $3.90 per $500 from $200,000 to $350,000. Above $350,000 a different schedule applies to the whole amount: $2.90 per $500 up to $150,000, $4.25 per $500 to $200,000, $4.80 per $500 to $550,000, $5.30 per $500 to $850,000, $5.80 per $500 to $1,000,000, and $6.05 per $500 above that. Reduced schedules exist for senior, blind, disabled, and low and moderate income sellers, and a notarized Form RTF-1 must be annexed to the deed to claim one. Consideration over $1,000,000 also triggers the Graduated Percent Fee that replaced the old 1 percent mansion tax on July 10, 2025 under P.L. 2025 c. 69: 1 percent above $1,000,000, 2 percent above $2,000,000, 2.5 percent above $2,500,000, 3 percent above $3,000,000, and 3.5 percent above $3,500,000, charged as a straight percentage of the entire consideration rather than as brackets. Liability for it shifted from the buyer to the seller, and the Division of Taxation is explicit that the operative date is when the deed is submitted for recording, not the closing date. Form RTF-1EE must be annexed to every deed over $1,000,000 and to every commercial transfer. There is no separate Union County transfer tax. When each one applies is explained in the requirements below.

The GIT/REP form is absolute: Form GIT/REP-3 states that if it is not completed in its entirety, or the settlement agent does not submit the original with the deed, the county will not record the deed. Form RTF-1 must accompany any deed claiming a full or partial Realty Transfer Fee exemption, and Form RTF-1EE must be annexed to every deed over $1,000,000 and every commercial transfer. Since May 1, 2017, under P.L. 2011 c. 217 (N.J.S.A. 46:26A-5), every land document must carry the county cover sheet whether it arrives by mail, courier, in person, or electronically, and the Clerk counts the cover sheet as a page in calculating the recording fee. A document submitted without the cover sheet and without the $20 statutory indexing fee is rejected and returned; it can be resubmitted with the cover sheet and the extra $10 page fee or with the $20 indexing fee. Flat fee documents skip the $10 cover page charge but still owe the $20 if the cover sheet is missing, and escrow account clients are recorded and debited the $20.

What actually holds up a closing here

In Linden the purchaser must obtain the housing certificate

Linden reverses the usual allocation. City Code section 10-20.22 provides that before any structure for any use may be transferred, the purchaser must procure a certificate of occupancy for housing inspection from the field representative for housing inspection, and the certificate will not issue unless the building conforms to the Building Code, the zoning chapter, and the housing code. The fee is $50 per residential unit, and the application must be accompanied by a copy of a survey of the premises, so the buyer cannot apply until the survey is in hand. Put the application on the buyer side of the task list and order the survey early. Business occupancies use a separate form: the City's $200 Application for Continued Certificate of Occupancy asks for the business name and description, carries zoning and property maintenance approval lines and routing boxes for the fire department, board of health, licensing, and weights and measures, and asks whether open permits exist.

Plainfield wants a licensed heating certification before it issues

Plainfield Municipal Code section 6:5-2 requires a Certificate of Compliance before the sale, transfer, rent, or lease of property. The City's sale application, revised 3/2018, lists $50 for the first residential unit, $25 for each additional unit at the same location, $300 for a commercial unit, and a $25 no show fee, with inspections run between 10:00 and 12:30. A clear certificate needs three supporting documents: a certificate on the heating system on the certifier's letterhead with a license number, the smoke detector, carbon monoxide, and fire extinguisher certificate, and for three or more units the New Jersey Bureau of Housing Inspection certificate. If violations remain at closing, a temporary certificate requires that every item printed in bold on the violation list be abated and reinspected first, plus a notarized buyer's affidavit assuming responsibility for abating all remaining violations, an escrow of $500 per unit by certified check or money order, the heating and smoke certificates, any required permits with payment, and documentation of the closing date.

Cranford's fire certificate will not issue with an open permit

Cranford's Building Department states that the Township does not mandate a CO for the resale of a home, but the seller must contact the Fire Prevention Bureau at 908-709-7360 for a Continuing Certificate of Occupancy and smoke detector certification. Township Code section 223-11, most recently amended 5-20-2025 by Ordinance 2025-07, folds a $50 smoke and carbon monoxide inspection fee into the certificate application fee and bars issuance unless ten year sealed battery or hardwired interconnected smoke alarms are installed on each level, carbon monoxide alarms comply with state and local law, secondary power sources are labeled under P.L. 2025 c. 19, stormwater systems and sump pumps comply with section 255-15D, house numbers are visible under section 169-3A, and all building permits are closed. The permit condition is the one that turns a routine fire inspection into a closing delay, so pull the permit history at listing.

Westfield's smoke certificate fee is capped at $175

Westfield Town Code section 11-45.1, last amended 6-3-2014 by General Ordinance No. 2023, governs smoke detector and carbon monoxide alarm compliance in buildings with one or two dwelling units and caps the inspection fee by lead time measured in business days before the change in occupancy: not more than $125 when the application is made more than 10 business days ahead, $150 at fewer than 10 but more than four, and $175 at fewer than four. The actual fee within those caps is set by Town Council resolution, and the Fire Department issues the certificate once compliance is established. Because the ladder counts business days, a closing set the Monday after a holiday weekend can slip into the top tier faster than the calendar suggests.

In Union County the cover sheet is itself a recorded page

Since May 1, 2017 the Union County Clerk has required its cover sheet with every land document, and its notice states that the cover sheet counts as a page in calculating the recording fee. A document that arrives without the cover sheet and without the $20 statutory indexing fee is rejected and returned, and it can be resubmitted with the cover sheet plus the extra $10 page fee or with the $20 indexing fee instead. Flat fee documents are exempt from the $10 cover page charge but not from the $20 indexing fee. Union also collects a $5 Homelessness Trust Fund surcharge on each recorded document, which the Clerk states is in addition to any other recording fee, so build both into the recording line on the settlement statement.
