Realty transfer tax in Monroe County: 2.0%

Monroe County is uniform: 1% to the Commonwealth, 0.5% to the municipality, and 0.5% to the school district, for 2.0% in every one of the 20 municipalities. The Recorder of Deeds fee bill effective November 17, 2025 lists realty transfer taxes as 1% state and 1% local, and the PA DCED 2026 local tax register shows 0.5% municipal and 0.5% school district for all 16 townships and all 4 boroughs across the Stroudsburg Area, East Stroudsburg Area, Pocono Mountain, and Pleasant Valley school districts. A REV-183 Statement of Value is required any time the transfer tax is not paid or the true value is not shown on the deed, and the Recorder wants it in duplicate, signed and dated, with the date of acceptance filled in and an asterisk next to the figure the tax is being paid on. Recording a deed in Monroe County

The Monroe County Recorder of Deeds sits at One Quaker Plaza, Room 106, Stroudsburg, PA 18360, 570-517-3969. The current recording fee is $87.75 for a deed plus $10.00 per tax code number, effective November 17, 2025. That is the current figure on the fee bill effective November 17, 2025 and revised November 18, 2025 with no fee change. Each page over four is $2.00, each name over four is $0.50, and each tax code number on each document is $10.00. The same fee bill states that all documents being recorded must have a tax code number, so the $10.00 is not optional: a one parcel deed of up to four pages and four names is $97.75 before transfer tax, and each additional parcel on the deed adds another $10.00. The office is open 8:30 to 4:30 on weekdays in the Administration Building, and appointments are not required but strongly encouraged. E-recording runs through CSC, ePN, and Simplifile. Personal checks are not accepted; payment is by cash, certified check, money order, business check, or credit card with a convenience fee, and it must be in the correct amount because no change or refunds are given. Paper submissions need a self-addressed stamped envelope, and every rejected document carries a $2.00 service charge.

Every document must carry the Tax Parcel Number on its first page, along with a property description that names the municipality. The Recorder lists a PIN supplied in place of the Tax Parcel Number as its first common reason for rejection, followed by wrong slashes or dashes in the number and a number that does not match the legal description or the township or borough. The Statement of Value is the next gate: it is rejected for a missing date of acceptance, a missing signature or date, the wrong municipality, school district, or parcel number in Section C, or a stale common level ratio. Deeds, mortgages, and assignments need a signed, precise address for the grantee, mortgagee, or assignee. A deed claiming a trust exemption must be followed by a copy of the trust, which the office prints and sends to the Commonwealth at $0.50 per page.

East Stroudsburg requires a resale inspection and certificate of occupancy

East Stroudsburg Borough Code section 122-14, added by Ordinance No. 1211, approved September 2, 2008, puts the duty on the legal owner to notify the Code Enforcement Officer not less than 15 days prior to the change of ownership of any building or structure. The inspection covers zoning compliance, smoke detectors, fire-resistance ratings, handrails and guards, electrical safety including GFCI outlets, sidewalks and curbs, plumbing, and street numbering, and the owner or an authorized agent has to be present for the whole inspection. The Borough delivers its report within 10 working days of the request, reinspects within seven working days of a completion notice, and issues the certificate within 24 hours if the property is then in compliance. Section 122-14C(2) allows an as-is purchase, but an estimated cost for the items to be corrected must be submitted to and approved by the Borough and the purchaser must accept the condition of the property in writing and certify that the work will be completed within 18 months. The cash escrow is narrower than the repair list: the code requires a cash deposit based on the cost estimate for the repair or replacement of any curb, sidewalk, or walkway to be escrowed with the Borough, and it does not call for an escrow of the other items. No occupancy of a dwelling is permitted if a hazardous situation exists, such as a structurally unsound dwelling or one lacking working sanitation or working smoke detectors. A transfer to a joint owner by right of survivorship and a transfer of an interest by mortgage are not treated as a change of ownership. Under Resolution No. 2-2026 the resale inspection is $129.00 for a single family dwelling and $129.00 per unit for multifamily, and a Real Estate Closing Final Figures Request, which covers water, sewer, trash, rental, and resale fees but not real estate taxes, is $74.00 per property. Middle Smithfield Township wants its use and occupancy certificate 15 days before a sale

Middle Smithfield Township Code Chapter 179, Use and Occupancy of Real Property, adopted May 25, 2017 by Ordinance No. 214, requires an owner who desires to lease or sell a building to obtain a certificate no later than 15 days prior to leasing or sale under section 179-3A. Timing cuts both ways, because section 179-3C makes the certificate valid only for a sale or lease occurring within 30 days after the date of issuance, so applying too early is as much a problem as applying late. The Township issues one of three results: a full certificate, a temporary use and occupancy certificate where violations are not substantial, or a temporary access certificate where a substantial violation exists, under which no person may occupy the property. After a purchase the violations must be corrected within 12 months of the date of purchase under section 179-4A, and section 179-3D requires the applicant to inform the buyer of the result of the inspection. The chapter is not limited to houses: it covers any building intended for human occupation, for residential or business purposes. Lenders taking title through foreclosure are exempt under section 179-8A. Section 179-6 sets fines of not less than $300 and not more than $1,000 plus costs of prosecution. The fee is set by resolution, so call the Zoning Administrator at 570-223-8920, extension 126, and ask for the Residential Resale Application.

Short-term rental licenses in Coolbaugh, Middle Smithfield, and Tobyhanna do not pass to the buyer

Three Monroe County townships say in their ordinances that a short-term rental license ends with the seller, so an investor buyer cannot count on booked income the day after settlement. Coolbaugh Township Code section 324-6I, under Ordinance No. 141-2020 as amended by Ordinance No. 159-2025, states that the license is personal to the owner identified in the application and does not run with the property, and that the new owner must apply for a license prior to renting the property as a short-term rental. Middle Smithfield Township section 150-6B(4) states that licenses are nontransferrable and that a new owner must complete a new license application and pay the annual fee before renting any part of the dwelling. Tobyhanna Township section 114-5A, adopted June 28, 2022 by Ordinance No. 569, requires the new owner to apply prior to renting whenever ownership changes by sale, deed transfer, death, change in the owning entity, sheriff sale, or court order. Chestnuthill and Stroud are less explicit. Chestnuthill Township section 100-6B (Ordinance No. 2019-02) issues a license only to the owner of the short-term rental property, for one year or until any governed condition changes, and Stroud Township section 11-206 (Ordinance No. 4-2020) issues a permit only to the owner of the premises, valid for no more than one year. Neither section read for this page spells out what happens on a sale, so in those two townships ask the township in writing whether the buyer must file a new application before the first booking. Fees in all five townships are set by resolution rather than in the ordinance, so get the current figure from the township before it goes on a net sheet.

Bedroom counts on a short-term rental are capped by the sewage permit

The occupancy an investor is underwriting is set by ordinance and, in most townships, by the septic permit rather than by the listing. Coolbaugh section 324-10A and Middle Smithfield section 150-7A both cap overnight occupancy at two persons per bedroom plus four, or 14, whichever is less. Tobyhanna section 114-8 allows two per bedroom plus two, and Chestnuthill section 100-7A allows two per bedroom. Stroud Township section 11-207 uses a table: 6 occupants for two bedrooms, 8 for three, 10 for four, and 12 for five. Coolbaugh, Stroud, Tobyhanna, and Chestnuthill each limit the number of bedrooms to the number approved on the sewage permit for the dwelling, Coolbaugh also bars a short-term rental in any dwelling that uses a sewage holding tank, and Middle Smithfield requires proof that the septic system was inspected, is working, and was pumped within three years. On any Pocono purchase marketed by sleeping capacity, pull the sewage permit during the inspection contingency and compare it to the bedroom count in the listing.

Private community resale certificates carry a five day cancellation right

Much of the housing stock in the Pocono townships sits inside private communities, and where the Uniform Planned Community Act applies, 68 Pa.C.S. section 5407 controls the resale. On a resale by a unit owner other than the declarant, the seller must furnish the purchaser, before the contract of sale is signed or otherwise before conveyance, a copy of the declaration, the bylaws, the rules or regulations of the association, and a certificate that covers, among other items, the monthly common expense assessment, any unpaid assessment currently due from the seller, other fees, capital expenditures proposed for the current and next two fiscal years, reserves, the current operating budget, insurance, judgments and pending suits, and known violations. The association has ten days after the owner asks to furnish that certificate, and the purchase contract is voidable by the buyer until the certificate has been provided and for five days thereafter, or until conveyance, whichever comes first. The buyer is not liable for any unpaid assessment or fee greater than the amount stated in the certificate, which is why the certificate date matters on the settlement statement. Order it the day the agreement is signed. The same subsection says the seller is not liable to the purchaser for the association's failure or delay in providing the certificate, so the cancellation right, not a claim against the seller, is the buyer's protection. Middle Smithfield Township separately states that some homeowner and property owner associations restrict or prohibit short-term rentals and strongly recommends contacting the association for its rules before applying for a township short-term rental permit.

Rental purchases in the boroughs and Stroud Township start a short notice clock

Both boroughs require each owner of a regulated rental unit to notify the code enforcement officer in writing within five business days after any change in ownership, under Stroudsburg section 11-208.1A (Ordinance No. 1153, September 5, 2023) and East Stroudsburg section 124-8A(1) (Ordinance No. 1261). Stroudsburg licenses are applied for by September 1 each year with inspections every three years, and the code states that a resale inspection or certificate of occupancy does not relieve the obligation of obtaining a regulated rental unit inspection. East Stroudsburg licenses are due by August 1 each year at $116.00 per regulated rental unit under Resolution No. 2-2026, with at least one inspection every two years. Stroudsburg Borough also states that persons moving into a commercial or residential dwelling must obtain a certificate of occupancy, and that a permit is required for each new occupant or tenant of a structure, which is the property owner's responsibility; the Borough is at 570-421-5444. In Stroud Township, section 11-103 gives anyone who becomes a landlord by agreement of sale or deed 30 days to submit the tenant registration report.

Pocono Township septic tanks are on a four year pumping cycle

Pocono Township states that households with on-lot septic systems need to pump their tanks every four years, under its On-Lot Sewage Disposal System Management Ordinance No. 96 as amended by Ordinance No. 97, and it provides a Sewage Pumping Report form to document the pump-out. The requirement runs on the calendar rather than on the sale, so a seller can be out of cycle with no closing event to surface it. Ask for the last pumping report at listing, and if there is none, schedule the pump-out before the buyer's septic inspection rather than after it.
