Realty transfer tax in Schuylkill County: 2.0% in most municipalities, 1.7% in Tower City
In nearly every Schuylkill municipality the realty transfer tax is 2%: 1% to the Commonwealth, 0.5% to the municipality, and 0.5% to the school district. The Recorder of Deeds fee schedule effective November 17, 2025 quotes deeds at the recording fee plus 2% transfer tax if applicable. One lower rate appears in the PA DCED Municipal Statistics tax register for 2026, and DCED is the only published source we found for it: Tower City Borough is listed at 0.2% municipal plus 0.5% for Williams Valley School District, a 0.7% local total and 1.7% overall. Confirm the Tower City rate with the Recorder at 570-628-1480 before you draft a settlement statement there. Rush Township is the one to read carefully. DCED lists it at 1% municipal and 1% school district in both its Tamaqua Area and Mahanoy Area portions, which would add up to 3%. Those read as face rates: Rush Township Code section 295-18, adopted November 11, 1993 by Ordinance No. 1993-1, imposes 1% and cuts it to one half whenever another political subdivision taxes the same transfer, and Tamaqua Area School District describes its 1% transfer tax as shared with other taxing authorities. Read that way Rush comes out at the same 2% the Recorder quotes, but no county source says so for Rush by name, so confirm the figure with the Recorder before closing. Mahanoy City Borough Code section 171-13 uses the same 1% with halving clause, adopted July 7, 1987 by Ordinance No. 87-4, and DCED lists Mahanoy City at the usual 0.5%. A Statement of Value (REV-183) goes with the deed when the full consideration is not stated in the deed, the transfer is a gift or without consideration, or an exemption is claimed.

Recording a deed in Schuylkill County
The Schuylkill County Recorder of Deeds sits at Schuylkill County Courthouse, 401 North Second Street, Pottsville, PA 17901, 570-628-1480. The current recording fee is $87.75 for a deed, effective November 17, 2025. The $87.75 deed and mortgage fee covers four pages and four names; each additional page is $4.00 and each additional name is $1.00. An assignment of mortgage, satisfaction piece, or release of mortgage is $61.75. Since 2016 the office has not accepted personal checks or personal business checks; it takes licensed law firm checks, certified bank checks, money orders, and cash, payable to the Schuylkill County Recorder of Deeds. A document rejected for any reason that came in by mail, UPS, or FedEx incurs a $3 rejection and return fee, and mailed submissions need a self-addressed stamped envelope. The Recorder urges e-recording because it combines the Recorder and Tax Assessment steps in one pass and avoids the rejection fee. The courthouse is open to the public Monday through Friday, 8:30 to 4:30, and the office issues no refunds under any circumstances.
A tax parcel ID certification stamp from the Schuylkill County Tax Assessment Office is required on all deeds, mortgages, easements, rights of way, subdivision maps, and any other document carrying a legal description or parcel number, and it must be completed before recording. What actually holds up a closing here
Pottsville use registration certificate before an apartment building goes under agreement
Pottsville City Code Chapter 172, Property, Sale of, adopted December 10, 1991 by Ordinance No. 457, applies to residential buildings limited to multifamily dwellings of three or more units. Section 172-3 requires the owner to obtain a use registration certificate from the Code Enforcement Office prior to entering into any agreement of sale, or before transfer when no agreement is used. Under section 172-4 the fee is $50 and the officer has 15 days to review records and inspect, and the certificate lists every existing building, plumbing, electrical, safety, or fire violation. The certificate is good for six months with up to two three-month extensions at no added fee. Section 172-5 requires every agreement of sale to state the property's district classification and whether its present use complies with district laws and ordinances. Section 172-7 requires the owner to deliver the certificate to the purchaser at or before signing, and the owner must return the purchaser's signed receipt to the Code Enforcement Office as evidence of compliance. Section 172-6 says the requirement cannot be waived by agreement. Foreclosure sales, tax sales, other judicial sales, and properties with a valid demolition permit are exempt, and section 172-10 sets a fine of up to $600.
New assessed values took effect January 1, 2026
Schuylkill County completed its first countywide reassessment since 1996 under a 2022 consent decree, and the county states the new assessed values took effect January 1, 2026. Change of assessment notices went to all 92,000 properties on July 1, 2025, owners had 40 days to appeal, and decisions from the Board of Assessment Appeals can be appealed to the Court of Common Pleas within 30 days. Millage was reset to the new base: the DCED register shows the City of Pottsville levy falling from 27.22 mills in 2025 to 5.363 mills in 2026, and the county tax rate table lists Pottsville Area School District at 9.1727 mills on the new values. Prorate on the actual 2026 bill and the new assessed value, never a 2025 bill, and on a recent purchase check whether a pending appeal could still change the number.
Coal-region rental ordinances give the seller five business days and the buyer 30 days
Tamaqua, Mahanoy City, and St. Clair use a common rental registration model. Tamaqua Code section 253-8, adopted September 18, 2001 by Ordinance No. 545, requires the transferring owner to notify the Code Enforcement Officer within five business days with the new owner's name, address, and phone, and makes it a violation not to register within 30 days following the purchase; section 253-9 bars occupancy without a registration license and certificate of compliance. Mahanoy City Chapter 156, adopted March 8, 2011 by Ordinance No. 2011-2, has the same five-day and 30-day rules, with inspection at least every three years at $75 for the first unit and $30 for each additional unit. St. Clair Ordinance No. 398 of October 2008, amending Chapter 133, repeats both deadlines and sets inspection at $30 per unit. Licenses do not transfer, so the buyer files fresh.
Schuylkill Haven wants notice within 24 hours on any two-unit or larger building
Schuylkill Haven Borough Code Chapter 124, Housing Standards, section 124-13A, requires anyone operating a multiple dwelling, defined as any dwelling with two or more units, to hold a multiple dwelling permit issued in the operator's name. The same subsection requires every permit holder to give written notice to the Code Enforcement Officer within 24 hours after having sold, transferred, given away, or otherwise disposed of ownership of, interest in, or control of the building, including the successor's name and address, and it states that no permit is transferable. That is the shortest post-closing clock in the county, so have the seller sign the notice at the table. Permit fees are set by Borough Council resolution.
Pottsville can inspect a rental on change of ownership
Pottsville City Code Chapter 176, Rental Property, adopted March 13, 2023 by Ordinance No. 910, inspects rental units once every five years on a rotating district schedule, but under section 176-7A if a residential rental unit or short-term rental changes ownership, the City reserves the right to inspect that unit regardless of district. The inspection fee is $50 per unit, paid before the inspection. The owner and any agent need a current business license from the City Tax Administrator, and tenants must be registered with the City Tax Office within 10 days of occupancy. Penalties run $300, $600, and $1,000 for first, second, and later violations, each day a separate offense.
Shenandoah requires an occupancy permit before anyone moves in
The Borough of Shenandoah states that under Chapter 27, Zoning, an occupancy permit must be secured prior to occupying any residence or property, and Ordinance No. 2011-4 requires every rental unit to be registered with the Borough and inspected for compliance. The Borough's ordinances page gives no occupancy permit fee or lead time, so call Borough Hall at 15 West Washington Street, 570-462-1918, as soon as the agreement is signed. The Borough also warns that failure to comply with its code results in maximum fines.
