Recording a deed in Sullivan County

The Recorder will not accept a deed without a properly assigned Uniform Parcel Identifier certified with the embossed seal of the Sullivan County Assessment Office, under County Ordinance 9301-76 as amended. The fee schedule lists what every deed must include: the parcel identification number from the Assessment Office, the notarized signature of the grantor, a certificate of address for the grantee for mailing tax bills, an Affidavit of Value if applicable, a copy of the trust if one is involved, and a self-addressed stamped envelope for the return. The earlier fee schedule stated that a $10.00 parcel certification stamp charge is built into the listed fee for documents that need the stamp. What actually holds up a closing here
The seller has to get the parcel number certified before the deed can record
Sullivan County Ordinance 9301-76, the Uniform Parcel Identifier Ordinance, makes it the obligation of the seller, grantor, transferor, or agent to obtain the Uniform Parcel Identifier from the Assessment Office prior to the transfer, and directs the Recorder not to accept a covered document unless it carries an identifier certified with the Assessment Office's embossed seal. As amended June 1, 2004, the identifier is required on all deeds, easements and right-of-way agreements, declarations of trust, leases, and condemnations for right-of-way purposes; mortgages, mortgage assignments, and satisfaction pieces do not need it. Section 6 of the ordinance has the Recorder assess a $25.00 fine on anyone who submits a document that does not comply, and lets the Recorder hold the document after recording until the fine is paid. Send the draft deed to the Assessment Office, 245 Muncy Street, Suite 105, Laporte, 570-946-5061, before the closing date is locked, and allow extra time when the description has changed, because the office asks for a survey when a description is corrected or the parcel changes size.
Clean and Green land adds a 30-day notice and a five-business-day hold
A July 17, 2001 amendment to the Uniform Parcel Identifier Ordinance ties Clean and Green directly to recording. When the parcel is enrolled, the seller must submit the 30-Day Notification of Conveyance in writing to the Assessment Office, and the office then has five business days to process the notice before it certifies the deed. The notice form itself says the current landowner must give it to the County Assessor 30 days prior to any transfer, split-off, or separation of enrolled land. The amendment also says the office may certify before the 30 days run out, but the five business days are the office's to use. Ask at listing whether the land is enrolled, and file the notice as soon as the contract is signed. Recording a Clean and Green amendment or rollback is $28.50 on the Recorder's fee schedule.
Deeds that split or combine parcels are screened for subdivision
An amendment to Ordinance 9301-76 directs the Recorder to verify, or to get a determination from the Land Use Administrator or another official designated by the Sullivan County Planning Commission, that a deed does not constitute a subdivision before recording it, and to reject deeds that do. Subdivision plans record only with an original approval signature from the Planning Commission Chair or Vice Chair, or from the Land Use Administrator on a minor subdivision. A separate county ordinance covers adding an adjoining lot to an existing parcel: the owner records a second deed that describes all the contiguous parcels, states that they are to be considered one for tax and subdivision purposes, and matches word for word a preliminary deed approved in advance by the tax assessor and the county planner. Delinquent tax certificates are ordered in writing from the Tax Claim Bureau
The Sullivan County Tax Claim Bureau issues a Tax Certificate for delinquent property taxes for $15.00, or a Tax Statement for $10.00. The check is made payable to the Sullivan County Tax Claim Bureau and must be included with a written request that gives the owner's name and the property parcel number, mailed to 245 Muncy Street, Suite 105, P.O. Box 157, Laporte, PA 18626. Because the request travels with a check, order it when title is opened rather than the week of closing. Eagles Mere properties: public sewer within 150 feet, borough rules on septic
Eagles Mere Borough Code Chapter 79 requires every property owner whose property line is within 150 feet of a public sewer line to connect (section 79-3), and section 79-4 bars anyone from connecting to, opening, altering, or disturbing the sewer system without a written permit from the Authority. For properties on septic, Article III lets the Borough's agent inspect any on-lot system on 72 hours' written notice by certified mail, allows the Borough by resolution to require periodic tank pumping with the hauler's receipts submitted to the Borough, and under section 79-12 lets the Borough do the required work itself, charge the owner, and enter a lien when the Sewage Enforcement Officer gives written notice of an imminent health hazard from an owner's failure to maintain, repair, or replace the system.
